The short version, as of October 2026
"Legal" depends on the substance, the place, the act and the date. This table is the US federal baseline and the main legal routes. The guides go state by state and country by country.
| Substance | US federal status | Main legal routes today |
|---|---|---|
| Psilocybin | Schedule I: illegal outside research | Oregon licensed service centers; Colorado healing centers; New Mexico medical program due by Dec 31, 2026; Australia via authorised psychiatrists |
| MDMA | Schedule I: not FDA-approved | Clinical trials; Australia via authorised psychiatrists for PTSD |
| Ketamine | Schedule III: prescription medicine | Approved anesthetic; esketamine (Spravato) approved for treatment-resistant depression in certified settings; IV ketamine for depression is off-label |
| Ibogaine | Schedule I: illegal outside research | No approved US use; FDA asked for input on trial design in Oct 2026 (comments close Nov 20, 2026); clinics operate abroad |

- Are Magic Mushrooms Legal in California? Status as of 2026-10-26
No. Magic mushrooms are illegal in California. Psilocybin and psilocyn are Schedule I under state law (Health and Safety Code 11054), and possession is punishable by up to one year in county jail (section 11377). Four cities told police to treat it as a low priority, which changes no statute. As of 2026-10-26, no bill has passed.
- Is Ibogaine Legal in the US? Federal, Texas and FDA Status as of 2026-10-26
No. Ibogaine is a Schedule I controlled substance under federal law (21 CFR 1308.11), so possessing or giving it outside registered research is illegal. FDA opened a public comment docket on ibogaine trial design on October 6, 2026; it closes November 20. If you want access, the lawful route today is a registered clinical trial.
Find the legal route that is open to you
Most people asking "is it legal?" want to know what they can do. The guides map every route that exists: Oregon service centers and Colorado healing centers, ketamine and Spravato clinics, Australia's authorised prescribers, Canada's special access requests and clinical trials that are recruiting.
You get the steps to check a license, what a session costs from the program's own data, and the health conditions that rule a substance out, so you walk in knowing what to ask.

- Dated. Every guide shows when it was updated and when each source was checked.
- Law, plan and forecast labelled. You always know which dates are real and which are predictions.

Common questions
Are magic mushrooms legal anywhere in the US?
Not under federal law: psilocybin is a Schedule I controlled substance. Oregon and Colorado run state-licensed programs where adults can take psilocybin under supervision, and Colorado also decriminalized personal use for adults. New Mexico says its medical program is set to be implemented by December 31, 2026. Everywhere else, possession is illegal under state law, even in cities that have made it a low police priority.
What does "decriminalized" mean?
It usually means police and prosecutors treat personal possession as a low priority, or that penalties are reduced. Selling stays illegal, state and federal law still apply, and the next town can still arrest you. Each guide spells out exactly which acts a local measure covers.
Is ketamine therapy legal?
Yes. Ketamine is a Schedule III prescription drug approved as an anesthetic, so doctors can legally prescribe it off-label for depression. Esketamine, sold as Spravato, is FDA-approved for treatment-resistant depression and is given in certified clinics with monitoring afterwards. Rules for telehealth and at-home use differ by state.
Would FDA approval make psilocybin or MDMA legal?
Only for the approved product, prescribed for the approved condition under the conditions FDA sets. Mushrooms, and MDMA outside that product, would stay controlled substances unless their federal schedule changes. A company saying it expects approval is a forecast, not a date.
